Defamation evaluation

Every assignment starts with an attorney reading the review against the law. Is it a statement of fact or opinion? Is it false? Does it identify you? Is it defamatory per se (accusing you of a crime, a communicable disease, professional misconduct or sexual impropriety)? You get the answer in writing, with the reasoning. If the content is not actionable, we say so and tell you what you can still do: flag it under the platform's own policies, respond publicly, or document it in case the poster continues.

Cease-and-desist and retraction demands

A letter on the firm's letterhead to the poster (or their counsel) identifying the false statements, the harm, and the legal exposure, and demanding removal and a retraction by a deadline. Florida's pre-suit notice requirement is satisfied at the same time, so the letter is also the first step toward a lawsuit if one becomes necessary. We report whether contact was made and by what method: phone, email or mail.

Platform legal removal requests

Google, Yelp, Meta (Facebook and Instagram), X, TikTok, YouTube, Angi, BBB, Trustpilot, Glassdoor and the rest each have a legal-removal channel distinct from the 'flag' button. We file through it with the record: the evaluation, the evidence that the statements are false, and the demand letter. Platforms act on policy violations and on content that an attorney has set out as defamatory far more often than on anonymous flags.

Unmasking anonymous posters

When the poster hides behind a fake name, a lawsuit against a John Doe defendant and a subpoena to the platform can compel disclosure of the account's registration and IP information. We advise you whether the content and the damages justify that step before taking it.

Defamation litigation

When demands fail and the harm is real, we file. Injunctions ordering removal, damages for lost business and reputational harm, and in defamation per se cases damages presumed by law. Litigation is quoted separately and nothing is filed without your written go-ahead.

Ongoing coverage

Sustained attacks rarely stop at one review. On a monthly plan each new post becomes a new assignment the moment you upload it, with the history of the earlier ones already on file.
